1. Acceptance of Terms

  • You are at least 21 years of age with a valid driver’s license.

  • You understand and accept all risks involved with UTV use, including bodily injury, property damage, or death.

  • You accept full responsibility for all damage to the rental equipment, regardless of fault.

  • You accept full liability for any and all injuries, including injury to yourself, your passengers, or third parties, during the use of the vehicle.

  • You waive the right to hold [Your Company Name], its owners, employees, or affiliates liable for any damages, injuries, or losses.

2. Booking & Payment Policy

  • Rentals must be paid in full at the time of booking to confirm your reservation.

  • A valid credit/debit card is required and will be held for a security deposit in case of damage or loss.

  • You must arrive 15 minutes before your scheduled time for check-in and orientation.

  • Late returns may result in additional fees.

3. Cancellations & Refunds

  • Cancellations made 48 hours or more before the rental time will receive a full refund.

  • Cancellations within 48 hours will not be refunded.

  • No-shows or early returns are non-refundable.

  • We reserve the right to cancel or reschedule due to weather, safety concerns, or mechanical issues. In such cases, a full refund or rescheduling option will be offered.

4. Damage, Theft & Repairs

  • You are financially responsible for any and all damage, including but not limited to: tires, rims, body panels, suspension, drivetrain, windshields, accessories, or electronics.

  • You are responsible for all towing, recovery, and repair costs if the vehicle becomes inoperable due to negligence or misuse.

  • In the event of theft, you are responsible for the full replacement value of the vehicle.

5. Safety Rules & Use Requirements

By renting from us, you agree to:

  • Wear seat belts and helmets (provided) at all times.

  • Not operate the UTV under the influence of alcohol, drugs, or any impairing substance.

  • Stay on designated trails and avoid private property, protected areas, or closed zones.

  • Refrain from reckless or aggressive driving (e.g., jumping, donuts, high-speed drifting).

  • Not exceed the passenger capacity of the vehicle.

  • Follow all local laws, trail rules, and posted signs.

6. Mechanical Issues

If you experience a mechanical problem:

  • Stop use immediately and contact our team.

  • Do not attempt repairs on your own.

  • We will do our best to assist or replace your vehicle as quickly as possible.

Mechanical breakdowns due to manufacturer defects or normal wear will not be charged. Breakdowns due to misuse, abuse, or neglect will be the Renter’s responsibility.

7. Insurance

[Your Company Name] provides basic liability insurance as required by the state of Utah. This does not cover damage to the vehicle or injuries to you or your passengers.

We strongly recommend you purchase optional rental insurance or verify your personal policy includes recreational vehicle coverage.

8. Assumption of Risk & Liability Waiver

By renting from [Your Company Name], you voluntarily assume all risks associated with UTV use, including but not limited to:

  • Rough terrain, rollover hazards, wildlife encounters, extreme weather, or trail conditions.

  • Injuries resulting from collisions, operator error, or equipment failure.

  • Legal or financial liability from accidents or citations.

You release and hold harmless [Your Company Name], its owners, agents, employees, and affiliates from any claims, demands, lawsuits, losses, or expenses related to your rental or use of our equipment.

9. Photo & Video Consent

We may capture or request photos/videos for marketing purposes. By participating in our rentals, you grant [Your Company Name] permission to use such media unless otherwise requested in writing.
